Trump Declares Biden Autopen Documents ‘Null and Void,’ Targeting Pardons and Orders

President Donald Trump issued a sweeping proclamation on Truth Social declaring all executive orders, proclamations, memorandums, contracts, and pardons signed via autopen during Joe Biden’s presidency “null and void,” escalating his long-running attack on the device’s use.
Trump claimed the autopen was “unauthorized” and tied its use to Biden’s alleged cognitive decline. “Any and all Documents… signed by Order of the now infamous and unauthorized ‘AUTOPEN,’ within the Administration of Joseph R. Biden Jr., are hereby null, void, and of no further force or effect,” Trump wrote, warning recipients—including those granted preemptive pardons such as Dr. Anthony Fauci and Gen. Mark Milley—to consider them “fully and completely terminated.”
The move builds on Trump’s assertion that 92% of Biden’s signatures were invalid. He threatened perjury charges if Biden denies authorizing the device, despite longstanding Justice Department opinions under multiple administrations—including George W. Bush’s—affirming autopen’s legality when approved by the president.
Legal experts quickly dismissed Trump’s declaration. Laurence Tribe of Harvard called it “constitutional nonsense,” noting that pardons are irrevocable under Article II and while executive orders can be revoked by successors, they cannot be retroactively voided. The House Oversight Committee, led by Rep. James Comer (R-KY), is probing autopen use, though no evidence has surfaced that Biden was unaware of documents signed with it.
The proclamation drew sharp partisan reactions. Critics such as Rep. Jamie Raskin (D-MD) labeled it a “vindictive stunt” aimed at political foes, while allies like Rep. Byron Donalds (R-FL) cheered: “INVALIDATE THEM ALL.”
The practical impact remains unclear, with predictions on lawsuits and congressional battles. The announcement comes as Trump continues to press his broader immigration and foreign policy agenda, while eyeing international recognition such as a Nobel Peace Prize for Ukraine talks.
